Distance selling contract is a contract established between the seller or provider and the consumer through the use of remote communication tools (such as telephone and internet) within the framework of a system created for remote marketing of goods or services, without the simultaneous physical presence of both parties.
- The consumer must be informed by the seller or provider about the goods or services before the contract is established. The purpose of preliminary information is to ensure that important issues regarding the goods or services are provided before shopping, so that consumers are aware of what they are about to purchase and what rights and obligations they have.
- The consumer has the right to withdraw from the contract within 14 days without giving any reason and without paying any penalty. The right of withdrawal can also be exercised during the period from the establishment of the contract to the delivery of the goods. If the preliminary information obligation is not fulfilled, the right of withdrawal period extends to 1 year.
- There are some exceptions to the right of withdrawal. For example, the right of withdrawal cannot be exercised in contracts for goods that can spoil quickly or may exceed their expiration date, or goods prepared in line with the consumer's requests or personal needs.
- To exercise the right of withdrawal, it is sufficient to notify the seller or provider in writing or with a durable data storage device.
- In case of exercising the right of withdrawal, the consumer must return the goods free of charge with the cargo company specified by the seller within 10 days, and the seller must make the refund within 14 days. The consumer is not responsible for changes and deteriorations that occur if they use the goods in accordance with its operation, technical specifications, and instructions during the withdrawal period.
- The seller or provider must fulfill their order within the committed time. In the sale of goods, this period cannot exceed 30 days. Otherwise, the consumer can terminate the contract.
